Thomas Schaffer v. Ronald Krantz & Dean Lightle
Multnomah County Circuit Court Case No. 131014942

This case involved a disputed liability automobile accident that occurred on I-84. The plaintiff alleged that he suffered permanent injuries. He claimed total damages in the amount of $124,981.64. The jury returned a defense verdict in favor of our client.

Michael Seeley v. Max Manufacturing, Inc.
Deschutes County Circuit Court Case No. 15CV0188

This case involved a products liability personal injury claim. The plaintiff sued a company that manufactured a part for a large solar array frame. The plaintiff was injured when he used the part as a lifting point while trying to move the solar array frame. His foot got crushed. He had multiple surgeries. The plaintiff claimed the following damages: non-economic damages $900,000.00; economic damages for medical expenses $97,845.10; future medical expense $100,000.00; and impairment of earning capacity $300,000.00. The total damages claimed were $1,397,845.10. The jury returned a defense verdict in favor of our client.

Stephen Sterba v. State Farm Mutual Automobile Insurance Company
Multnomah County Circuit Court Case No. 15CV14240

This case involved a claim by an insured against an insurer for alleged breach of contract. The insured’s Mercedes was damaged in an automobile accident sustaining approximately $30,000.00 in repair costs. The repair facility wanted to charge State Farm for the cost to rent fixtures for a frame bench. State Farm disputed whether these charges were reasonable. This issue had not been tried by State Farm in Oregon previously. The jury returned a defense verdict in favor of our client.

Adrian Shannon v. State Farm Mutual Automobile Insurance Company
Jackson County Circuit Court Case No. 15CV21880

This case involved a claim by an insured against an insurer for alleged breach of contract. The insured alleged that a specialty race car was stolen and he made a theft claim against the insurer. State Farm conducted its own investigation of the alleged theft and contended that the vehicle was not stolen. The jury returned a defense verdict in favor of our client.

Miguel Soto-Plancarte v.Genevieve Louise Gaudin
Multnomah County Circuit Court Case No. 14CV16114

This case involved an admitted liability automobile accident that occurred in a parking lot. The plaintiff prevailed in non-binding arbitration and was awarded damages and attorney fees. We appealed to the trial court. Following opening statements at trial, plaintiff settled for about one-third of the amount awarded at arbitration.

Kayla Milburn v. Ronald Wyatt
Washington County Circuit Court Case No. C145309CV

In this case, we defended an elderly driver that turned in front of the plaintiff, admittedly causing a significant collision. Over two years after the accident, plaintiff had back surgery. We successfully moved the court to change the place of trial to a more favorable venue, and then defended on a surgical causation theory. The plaintiff claimed total damages in the amount of $274,964.97, which included medical expenses in the amount of $74,964.97 and lost wages in the amount of $35,000.00. The jury returned a favorable verdict in the total amount of $43,949.16.

Miguel Gonzalez Reyes, et al. v. State Farm Mutual Automobile Insurance Co.
Multnomah County Circuit Court Case No. 14CV08156

In this case, a family alleged that State Farm breached its insurance policy by failing to pay for certain chiropractic bills. The plaintiffs prevailed in non-binding arbitration, and we appealed to the trial court. The jury returned a verdict in favor of State Farm with respect to the unpaid bills.

Clackamas County Circuit Court Case No. C14080027

This case involved a disputed liability automobile accident that occurred while the plaintiff was pulling out of a private driveway. Following the accident, plaintiff had shoulder surgery which he claimed was necessitated by the accident. The plaintiff claimed total damages in the amount of $205,000.00. The jury returned a defense verdict in favor of our client.

In this case, the plaintiff alleged that State Farm breached its insurance policy by failing to pay for certain medical bills. The plaintiff prevailed in non-binding arbitration, and we appealed to the trial court. The jury returned a defense verdict in favor of our client.

Emily Sunderman v. Walter Bromley
Multnomah County Circuit Court Case No. 1404-04246

This case involved an unfortunate accident between an elderly driver and a bicyclist that was trying to cross SE Powell Blvd at dusk. There were conflicting witness statements. We defended the driver on a theory that the plaintiff bicyclist caused the accident. The plaintiff claimed total damages in the amount of $186,000.00, which included damages for facial plastic surgery and permanent injury. The jury returned a defense verdict in favor of our client.

Jennifer Cuellar Medina v. Carmen Schuetz and Amayrani Hernandez Pineda
Marion County Circuit Court Case No. 13C23586

In this automobile accident case, the plaintiff sued the driver of the vehicle she was in and our client, who was driving a different vehicle. The plaintiff claimed total damages in the amount of $193,636.70, which included the cost of a future neck surgery. We denied liability for the causation of the accident and plaintiff’s damages. The jury returned a defense verdict in favor of our client.

Fuller v. Nava
Multnomah County Circuit Court Case No. 1404-03973

In this personal injury case, the plaintiff alleged $299,742.37.00 in total damages, including a claim for punitive damages in the amount of $10,000.00, for injuries suffered in a motor vehicle accident. We represented the defendant. The issues at trial were what were the plaintiff's injuries and damages. The jury awarded the plaintiff $1,690.24 for medical expenses, $10,000.00 for noneconomic damages, and $2,500.00 for punitive damages.

Cannon v. Flikkema
Multnomah County Circuit Court Case No. 140201841

In this personal injury case, the plaintiff alleged $394,314.00 in total damages for injuries suffered in a motor vehicle accident. The plaintiff alleged the accident caused injuries requiring surgery to his spine. We represented the defendant. The issues at trial were causation of the plaintiff's injuries and damages. The jury awarded the plaintiff $6,101.65 for medical expenses and $1,050.00 for noneconomic damages.

Multnomah County Circuit Court Case No. 14CV17517

In this personal injury case, the plaintiff alleged $137,520.00 in total damages for injuries suffered in a motor vehicle accident. We represented the defendant. The issues at trial were what were the plaintiff's injuries and damages. The jury awarded the plaintiff $16,338.00 for medical expenses and $27,600.00 for noneconomic damages.

Jason Dold v. Tamara Pearmine
Multnomah County Circuit Court Case No. 13-13045

This case involved an admitted liability car accident that occurred when the defendant pulled out in front of the plaintiff’s vehicle on West Burnside Road on a foggy night. The plaintiff alleged permanent injuries, which included a shoulder injury necessitating surgery. The plaintiff claimed total damages in the amount of $342,651.21. The jury returned a verdict in the total amount of $76,670.50, which was only slightly higher than defendant’s pre-trial settlement offer.

Jarad Davidson v. Kristina Fish
Washington County Circuit Court Case No. C127280CV

This case involved a disputed liability automobile accident that occurred at an intersection. The plaintiff alleged he suffered a spinal injury, and he claimed total damages in the amount of $198,906.47. We defended on a theory that plaintiff caused the accident by failing to keep a proper lookout. The jury returned a complete defense verdict in favor of our client.

Polk County Circuit Court Case No. 13P10994

This case involved a wrongful death claim arising out of a truck/bicycle accident on Highway 99W. The plaintiff alleged the defendant was negligent and claimed: non-economic damages $1,750,000.00; economic damages for pecuniary loss to the plaintiff’s estate $750,000.00. The total damages claimed were $2,500,000.00. The jury returned a defense verdict in favor of our client.


2012


Oregon Pallet Repair, Inc. et al. v. Garrison Pallet, LLC, et al.
Marion County Circuit Court Case No. 10C-24037

The case involved dispute between majority shareholders and a minority shareholder in a family corporation. The majority shareholders sued for breach of an agreement, injunctive relief, and a declaratory judgment. The minority shareholder filed a counterclaim against the majority shareholders. After a two week trial, the jury found in favor of the minority shareholder and awarded $1,000,000.00 in damages in favor of our client.
